Their legal fight doesn’t seem to be slowing down anytime soon!
Sofia Vergara is hoping to put an end to her nasty two-year battle over the frozen embryos she created with her ex-fiance Nick Loeb.
Blocking Her Ex From Taking Control
In court documents obtained by E! News, it states that the Modern Family star is trying to “officially block” Nick from taking control over the two female embryos they created while they were together or filing future lawsuits.
Sofia insists the court battle is a waste of time because Nick signed a contract about their frozen embryos, which were created in 2013, which make his rights clear, and she claims Nick only “voluntarily dismissed his case against her” in December so he could refile his case at a later date.
What’s more, the Columbian beauty wants the embryos permanently destroyed, something Nick is unwilling to do and he doesn’t want them permanently frozen either.
The On-Going Battle
Nick filed a right-to-live lawsuit against Sofia in Louisiana claiming the fertilised eggs – which he listed as ‘Emma’ and ‘Isabella’ – were being “deprived of a trust” that he created for them.
According to the suit, Nick believes that ‘Isabella and Emma’ are being deprived of this inheritance by not being born and should be allowed to live so they can receive that money.
His lawsuit also argues that he should have full custody over the embryos so he can implant them in a surrogate. He also argues that Sofia should have no parental rights.
But Sofia believes that “a child needs a mother and a loving relationship with parents that get along, that don’t hate each other.
“I wouldn’t want to bring kids to the world where it is already set everything wrong for them, It would be so selfish.
“I’ve been working very hard for 20 years to get to this point where I am. I don’t want to allow this person to take more advantage of my career and try to promote himself.”
Sources told the Page Six, Nick then texted his former fiancee: “You can’t keep 4 frozen lives forever or kill them, we will go to hell.”
“We r going to hell regardless,” Sofia allegedly responded.
The 44-year-old actress underwent two rounds of IVF when she was with Nick, but both failed. and when the couple split up, Nick reportedly texted her: “We still have those 2 frozen babies.”
The pair signed a contract at the ART Reproductive Center in Beverly Hills when they created the embryos, which stated neither of them could use the embryos without the consent of both.
However, Nick argues the agreement should be deemed void as it didn’t say what should happen if they split, and it violated California code and Louisiana law.
Sofia is now married to Magic Mike star Joe Manganiello and has a son Manolo, 24, from her first marriage to Joe Gonzalez.
